TITLE OF BILL:
An act to amend the public health law, in relation to decriminalizing
psilocybin
 
PURPOSE:
This legislation will decriminalize psilocybin.
 
SUMMARY OF SPECIFIC PROVISIONS:
Section one amends paragraphs 19, 20, 21, 22, 23, 24, 25, 26, 27, 28,
29, 30, 31, 32, 33, 34, 35, 36, 37 and 38 of subdivision (d) of schedule
I of section 3306 of the public health law, paragraphs 19, 20, 21, 22,
23, and 24 as added by chapter 664 of the laws of 1985, paragraphs 25,
26, 27, 28, 29, and 30 as added by chapter 589 of the laws of 1996,
paragraphs 31 and 32 as added by chapter 457 of the laws of 2006, para-
graphs 33, 34 and 35 as added by chapter 370 of the laws of 2015 and
paragraphs 36, 37 and 38 as added by section 5 of part BB of chapter 57
and the laws of 2018.
Section two establishes the effective date.
 
JUSTIFICATION:
Psilocybin is a naturally occurring chemical compound produced by
certain species of mushroom. It is the active ingredient in what are
colloquially called "magic mushrooms." In 2018,the United States Food
and Drug Administration designated the use of psilocybin as a "break-
through therapy for treatment-resistant depression," after reviewing the
work of Compass Pathways, which is conducting clinical trials exploring
its use in treating severe depression. One study demonstrated that a
single dose of psilocybin could assist cancer patients in combating
anxiety and dark moods, while others indicated the drug's ability to
help people struggling with substance use disorder, addiction to nico-
tine and anorexia nervosa. Many cities, including Denver, CO, Santa
Cruz, CA, and Oakland, CA, have already decriminalized the use and
possession of psilocybin, and New York should do the same. With the
opportunity to positively affect the lives of millions suffering with
mental health and addiction issues, this bill will decriminalize psilo-
cybin and allow further research into the study of the drug and its
beneficial uses for treatment.

The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraphs 19, 20, 21, 22, 23, 24, 25, 26, 27, 28, 29, 30,
2 31, 32, 33, 34, 35, 36, 37 and 38 of subdivision (d) of schedule I of
3 section 3306 of the public health law, paragraphs 19, 20, 21, 22, 23 and
4 24 as added by chapter 664 of the laws of 1985, paragraphs 25, 26, 27,
5 28, 29 and 30 as added by chapter 589 of the laws of 1996, paragraphs 31
6 and 32 as added by chapter 457 of the laws of 2006, paragraphs 33, 34
7 and 35 as added by chapter 370 of the laws of 2015 and paragraphs 36, 37
8 and 38 as added by section 5 of part BB of chapter 57 of the laws of
9 2018, are amended to read as follows:

11 (20)] Psilocyn.
12 [(21)] (20) Tetrahydrocannabinols. Synthetic equivalents of the
13 substances contained in the plant, or in the resinous extractives of
14 cannabis, sp. and/or synthetic substances, derivatives, and their isom-
15 ers with similar chemical structure and pharmacological activity such as
16 the following:
17 [/\] delta 1 cis or trans tetrahydrocannabinol, and their optical
18 isomers
19 [/\] delta 6 cis or trans tetrahydrocannabinol, and their optical
20 isomers
21 [/\] delta 3, 4 cis or trans tetrahydrocannabinol, and its optical
22 isomers (since nomenclature of these substances is not internationally
