AN ACT to amend the education law, in relation to certain tuition waiv-
ers for police officer students of the state university of New York
and the city university of New York; and providing for the repeal of
certain provisions upon expiration thereof
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraph h of subdivision 2 of section 355 of the educa-
2 tion law is amended by adding a new subparagraph 1-a to read as follows:
3 (1-a) Notwithstanding the provisions of any other provision of law,
4 rule or regulation, such regulations shall permit police officers, as
5 such term is defined in section two hundred nine-q of the general munic-
6 ipal law, who are enrolled in programs leading to baccalaureate or high-
7 er degrees at state-operated institutions of the state university to
8 attend up to two courses per semester or quarter without tuition,
9 provided that such tuition-waived attendance does not deny course
10 attendance at a state-operated institution by an individual who is
11 otherwise qualified under the regulations promulgated pursuant to this
12 section.
13 § 2. Paragraph (c) of subdivision 7 of section 6206 of the education
14 law, as added by chapter 548 of the laws of 2004, is amended to read as
15 follows:
16 (c) Notwithstanding the provisions of any other general, special or
17 local law, rule or regulation, the board of trustees shall promulgate
18 regulations to permit [members of the New York city police department
19 employed in the rank of police officer] police officers, as such term is
20 defined in section two hundred nine-q of the general municipal law, who
21 are enrolled in programs leading to baccalaureate or higher degrees at a
22 senior college of the city university to attend [one course] up to two

1 courses per semester or quarter without tuition, provided that such
2 [course is related to their employment as police officers and that such]
3 tuition-waived attendance does not deny course attendance at a senior
4 college of the city university by an individual who is otherwise quali-
5 fied under this section.
6 § 3. This act shall take effect immediately; provided that:
7 1. section one of this act shall expire and be deemed repealed July 1,
8 2023; and
9 2. the amendments to paragraph (c) of subdivision 7 of section 6206 of
10 the education law made by section two of this act shall not affect the
11 expiration and repeal of such paragraph and shall expire and be deemed
12 repealed therewith.
