        Introduced  by  M.  of A. J. D. RIVERA, CYMBROWITZ -- (at request of the
          New York State Homes and Community Renewal) -- read once and  referred
          to the Committee on Housing
 
        AN  ACT to amend the private housing finance law, in relation to author-
          izing statewide or regional multi-state  contract  administration  and
          support  services  for federal section 8 project based housing assist-
          ance payments contracts
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Short  title. This act shall be known and may be cited as
     2  the "State and Local Project Based Housing Assistance  Payment  Contract
     3  Administration Act of 2021".
     4    § 2. Subdivisions 10, 11 and 12 of section 45-a of the private housing
     5  finance  law, subdivision 11 as renumbered by chapter 261 of the laws of
     6  1988, are renumbered subdivisions 11, 12 and 13 and a new subdivision 10
     7  is added to read as follows:
     8    10. The corporation is a public  housing  agency  as  defined  in  the
     9  United  States  housing  act  of  1937,  as amended, and may receive and
    10  administer funds including but not limited to subsidies, loans and  fees
    11  made available through federal programs under such act.
    12    (a)  The  corporation  shall  be the sole entity with authority in the
    13  state to undertake any statewide or regional  multi-state  contract  for
    14  performance  based  annual  contributions contract administration issued
    15  under authority granted in 42 U.S.C. section 1437f  or  any  replacement
    16  program  or contract, whether called an annual contributions contract or
    17  other name, that  requires  substantially  the  same  administration  or
    18  support services offered nationally, regionally or statewide. The corpo-
    19  ration  may  in  its  discretion  subcontract  such activities as it may
    20  require. The division of housing and  community  renewal  shall  be  the
    21  entity  responsible  for such statewide or regional multi-state contract
    22  administration with all powers and responsibilities which  would  other-

     1  wise  be  available  to  the corporation in the event the corporation is
     2  unable or unwilling to act as such entity.
     3    (b)  The  powers vested in the corporation and the division of housing
     4  and community renewal pursuant to paragraph (a) of this subdivision  are
     5  coincident  to the powers of any municipal or other local public housing
     6  agency or public housing authority operating within  the  state  on  the
     7  effective  date  of this paragraph. The authority of the corporation and
     8  the division of housing and community renewal to operate on a  statewide
     9  basis  shall  not  limit  the authority of such municipal public housing
    10  agency or local public housing authority to operate, service, administer
    11  or enter into any project based section 8 contract  or  contracts  where
    12  the  project  is  located within a political subdivision of the state in
    13  which such public housing agency or public housing authority was operat-
    14  ing on such effective date.
    15    § 3. This act shall take effect immediately.
