AN ACT authorizing the county of Cattaraugus to transfer and convey
reforested lands in the town of Perrysburg to the state of New York
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Notwithstanding section 219 of the county law, and subject
2 to the provisions of this act, the county of Cattaraugus acting through
3 its legislative body, is hereby authorized to discontinue the use of
4 certain parcels of reforested land in the town of Perrysburg, more
5 particularly described in section three of this act, and to enter into a
6 contract to convey its interest in such real property to the state of
7 New York, upon the terms and conditions contained in this act, for use
8 by the state of New York.
9 § 2. The lands authorized to be alienated and conveyed pursuant to
10 section one of this act, and which are more particularly described in
11 section three of this act, shall be devoted in perpetuity; and the
12 conveyance of such lands from the county to the state shall be done
13 without compensation and shall not require the county to acquire any
14 replacement or substitute reforested lands.
15 § 3. The lands authorized to be alienated and conveyed by the county
16 of Cattaraugus pursuant to section one of this act shall be described as
17 "Perrysburg Pond", "Crocker's Pond", and "Bob's Pond", designated as Tax
18 Map No. 2.003-1-20.
19 § 4. The land to be transferred pursuant to this act, and all struc-
20 tures and facilities situated on such land, shall be maintained, owned
21 and operated for recreational purposes by the state of New York. The use
22 of such parkland and facilities shall continue to be made available to
23 the general public, including all residents of Cattaraugus County. Where
24 the availability of such facilities is limited, the use of such facili-
25 ties must be determined by an equitable method which provides priority
26 use to the general public based on a reservation policy for free or for
27 a nominal charge.
28 § 5. This act shall take effect immediately.
