        AN  ACT  to amend the vehicle and traffic law, in relation to applicants
          for a driver's license who  have  suffered  a  loss  of  consciousness
          resulting from the impact of a collision

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Paragraph b of subdivision 9 of section 502 of the  vehicle
     2  and  traffic  law,  as  amended  by  chapter  31 of the laws of 2020, is
     3  amended and a new paragraph g is added to read as follows:
     4    b. As used in this subdivision, the following  terms  shall  have  the
     5  following  meanings: "loss of consciousness" shall mean the condition of
     6  not being aware of one's surroundings or  of  one's  existence  and  the
     7  inability  to  receive, interpret or react to sensory impressions as the
     8  result of epilepsy, syncope, cataplexy, narcolepsy and  other  disorders
     9  affecting  consciousness  and control, but shall not apply to a state of
    10  unconsciousness caused by or directly resulting from  the  impact  of  a
    11  collision;  and  "evidence of loss of consciousness" shall mean a police
    12  accident report filed pursuant to section  six  hundred  three  of  this
    13  chapter  indicating  a loss of consciousness, no matter how denominated,
    14  as the cause of an accident, or admission by an applicant  or  licensee,
    15  or a complaint alleging loss of consciousness received from police agen-
    16  cies and others.
    17    g.  In addition to mailing a notice of suspension to a licensee pursu-
    18  ant to paragraph d of this  subdivision,  the  commissioner  shall  also
    19  provide  a  copy of such notice of suspension electronically to any such
    20  licensee who has an active online account with the department.
    21    § 2. This act shall take effect immediately.
