TITLE OF BILL:
An act to amend the public health law, in relation to the regulation of
smoking and vaping on the grounds and other outdoor areas of public
colleges and universities
 
PURPOSE:
To prohibit smoking and vaping on the grounds of public colleges and
universities.
 
SUMMARY OF PROVISIONS:
Section one adds colleges and universities to the list of eligible
institutions for preexisting school-based programs to prevent and reduce
tobacco use.
Section two amends the clean outdoor air act to outlaw smoking or vaping
on the grounds of public colleges and universities.
 
JUSTIFICATION:
To ensure that public colleges and universities are smoke-free to
protect the health and welfare of students, faculty and staff.

AN ACT to amend the public health law, in relation to the regulation of
smoking and vaping on the grounds and other outdoor areas of public
colleges and universities
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraph (b) of subdivision 2 of section 1399-ii of the
2 public health law, as amended by section 12 of part EE of chapter 56 of
3 the laws of 2020, is amended to read as follows:
4 (b) School-based programs, including those located at colleges and
5 universities, to prevent and reduce tobacco use and use of vapor
6 products;
7 § 2. Subdivision 2 of section 1399-o of the public health law is
8 amended by adding a new paragraph c to read as follows:
9 c. on the grounds or other outdoor areas of any public college or
10 university that are owned, leased or operated by such college or univer-
11 sity, except that the restrictions in this paragraph shall not apply to
12 any outdoor spaces or areas that are shared between the college or
13 university and private parties pursuant to a lease, or to such spaces or
14 areas that are not under the full and sole control of such college or
15 university.
16 § 3. This act shall take effect on the sixtieth day after it shall
17 have become a law.
