          printed to be committed to the Committee on Rules
 
        AN ACT to amend chapter 20 of the laws  of  1985  creating  the  Sanborn
          Volunteer  and  Exempt  Firemen's  Benevolent  Association,  Inc., and
          providing for its powers and duties, in relation to  its  purpose  and
          the use of foreign fire insurance premiums
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Sections 3 and 7 of chapter 20 of the laws of 1985 creating
     2  the Sanborn Volunteer and Exempt Firemen's Benevolent Association, Inc.,
     3  and providing for its powers and duties, are amended to read as follows:
     4    § 3. Purposes. The purposes of such corporation shall be  the  mainte-
     5  nance  of suitable headquarters for, and the promotion of friendly asso-
     6  ciation for the betterment of the members of such corporation and  their
     7  relations with the community, for the promotion of fraternal intercourse
     8  among  the  members  of such corporation, to study and disseminate among
     9  the members of such corporation the most efficient  manner  of  fighting
    10  fires, the relief, aid and assistance of such members and their families
    11  who  are injured, disabled or indigent, for the promotion and safeguard-
    12  ing of the welfare of the volunteer  members  of  such  corporation  and
    13  their  families,  for  the  provision  for  the health and safety of the
    14  volunteer members of such corporation, and for the  enhancement  of  the
    15  morale  of  the  volunteer  members  of  such  corporation  through  the
    16  provision of  social  and  recreational  activities  for  the  volunteer
    17  members  of  such corporation, and to acquire real and personal property
    18  such as may be necessary for the  purposes  herein  set  forth  and  the
    19  promotion of the welfare of the volunteer fire service within the terri-
    20  tory  now  served  or  which may hereafter be served by the Sanborn Fire
    21  Company.
    22    § 7. Precept for payment of foreign fire insurance premium taxes. Such
    23  corporation shall collect and there  shall  be  paid  to  it  all  taxes

     1  imposed  by  section nine thousand one hundred four of the insurance law
     2  for fire department use and benefit upon premiums for insurance  against
     3  loss  or damage by fire covering property within the territory protected
     4  by  Sanborn  Fire Company within the town of Lewiston located in Niagara
     5  county, New York. The officers of said  corporation  designated  by  its
     6  by-laws  to  collect  and  receive  the aforesaid tax shall have all the
     7  powers and be subject to all the provisions of the insurance law, relat-
     8  ing to treasurers of fire departments. Such corporation  shall  also  be
     9  entitled  to  receive  a  share  of  the tax distributed pursuant to the
    10  provisions of section nine thousand one hundred five  of  the  insurance
    11  law,  based  upon  the business written in the territory with respect to
    12  which it is entitled to collect and receive the tax under  section  nine
    13  thousand one hundred four of the insurance law. Such taxes shall only be
    14  used  [for  the  care  and  relief of disabled or indigent volunteer and
    15  exempt volunteer firemen and  their  families]  by  the  corporation  in
    16  furtherance of its purposes as set forth in section three of this act.
    17    §  2.  This act shall take effect immediately and shall apply to taxes
    18  due on premiums received on and after January 1, 2022.
