AN ACT to amend the environmental conservation law, in relation to elec-
tronic identification of hunting license holders and the tagging of
deer and bears
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subparagraph 1 of paragraph a of subdivision 1, subdivision
2 2 and subdivision 3 of section 11-0705 of the environmental conservation
3 law, as amended by section 21 of part R of chapter 58 of the laws of
4 2013, are amended to read as follows:
5 (1) have such license, tag or privilege on the holder's person in an
6 electronic or other acceptable format pursuant to regulations, while
7 exercising any privilege of that license stated in section 11-0701 of
8 this title, or while assisting or accompanying a minor in hunting as
9 provided in section 11-0929 of this article, and
10 2. [a. Holders of a hunting license while exercising the privileges of
11 such license, shall have the back tag issued with their license attached
12 to and displayed on the back of the outer garment between the shoulders
13 in such manner that all figures are plainly visible at all times.
14 b. The license tag for the current year only shall be displayed.
15 c. Notwithstanding the provisions of paragraphs a and b of this subdi-
16 vision, a license holder shall not be required to display such license
17 tag in the Northern Zone or the Catskill Park.
18 3.] Failure of a licensee to have the holder's license, tag or license
19 with bowhunting and/or muzzle-loading privilege included, on the hold-
20 er's person in an electronic or other acceptable format pursuant to
21 regulations, while hunting, fishing or trapping, is presumptive evidence
22 that the holder is hunting, fishing or trapping, as the case may be,
23 without holding the license, tag or license and bowhunting or muzzle-

1 loading privilege required by subdivision 6 of section 11-0703 of this
2 title.
3 § 2. Paragraphs a and b of subdivision 1 of section 11-0911 of the
4 environmental conservation law, as added by section 8 of part D of chap-
5 ter 61 of the laws of 2000, are amended to read as follows:
6 a. When a wild deer is taken the taker shall immediately fill [in,
7 using ink, ball point pen or indelible pencil, the deer tags issued to
8 the taker] out the deer tag in an electronic or other acceptable format
9 as provided in regulations of the department. [The taker shall imme-
10 diately cut out or mark the month and date of kill on the tag and shall
11 attach it to the deer, except that it need not be attached to the deer
12 while it is being dragged or physically carried by the taker to a camp
13 or point where other transportation is available.] The taker shall
14 report details of the location and date of harvest and data on the deer
15 as required by regulation.
16 b. When a bear is taken, the taker shall immediately fill out the bear
17 tag [issued to taker] in an electronic or other acceptable format as
18 provided in regulations of the department. The taker shall report
19 details of the location and date of harvest and data on the bear as
20 required by regulation.
21 § 3. This act shall take effect immediately; provided, however, that
22 section two of this act shall take effect August 1, 2025.
