        AN ACT to amend the education law, in  relation  to  the  smart  schools
          review board
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subparagraph 3 of paragraph b of subdivision 16 of  section
     2  3641  of the education law, as amended by section 3 of part YYY of chap-
     3  ter 59 of the laws of 2017, is amended to read as follows:
     4    (3) The smart schools review board  shall  review  all  smart  schools
     5  investment  plans for compliance with all eligibility criteria and other
     6  requirements set forth in the guidelines. The smart schools review board
     7  [may] shall meet at minimum once every three months to approve or reject
     8  such plans that have undergone such review, or may return such plans  to
     9  the school district for modifications; provided that notwithstanding any
    10  inconsistent  provision  of  law,  the  smart schools review board shall
    11  approve no such plan first submitted to the department on or after April
    12  fifteenth, two thousand  seventeen,  unless  such  plan  calculates  the
    13  amount  of  classroom  technology  to  be  loaned  to students attending
    14  nonpublic schools pursuant to section seven hundred fifty-five  of  this
    15  chapter  in  a  manner  that  includes the amount budgeted by the school
    16  district for servers, wireless access points and other portable  connec-
    17  tivity  devices to be acquired as part of a school connectivity project.
    18  At each such meeting, the smart schools review board shall announce  the
    19  date for their next meeting. Upon approval, the smart schools project or
    20  projects  described  in  the investment plan shall be eligible for smart
    21  schools grants. A smart schools project included in a school  district's
    22  smart schools investment plan shall not require separate approval of the
    23  commissioner unless it is part of a school construction project required
    24  to  be  submitted  for  approval of the commissioner pursuant to section
    25  four hundred eight of this chapter and/or  subdivision  six  of  section

     1  thirty-six hundred two of this article. Any department, agency or public
     2  authority shall provide the smart schools review board with any informa-
     3  tion it requires to fulfill its duties pursuant to this subdivision.
     4    § 2. This act shall take effect immediately.
