AN ACT to amend chapter 476 of the laws of 1957 relating to authorizing
the board of commissioners of the land office to grant certain ease-
ments in lands of the State University Agricultural and Technical
Institute at Farmingdale to Central Hudson Gas and Electric Corpo-
ration, in relation to the description of lands for which the Commis-
sioner of General Services is authorized to grant an easement to the
Central Hudson Gas and Electric Corporation
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Sections 1 and 2 of chapter 476 of the laws of 1957,
2 relating to authorizing the board of commissioners of the land office to
3 grant certain easements in lands of the State University Agricultural
4 and Technical Institute at Farmingdale to Central Hudson Gas and Elec-
5 tric Corporation, are amended to read as follows:
6 § 1. The [board of commissioners of the land office, with] Commission-
7 er of General Services, upon the consent [and approval of the board of
8 trustees of State University of New York] of the Commissioner of the
9 Department of Environmental Conservation, is hereby authorized to grant
10 and convey to the Central Hudson Gas and Electric Corporation, [a domes-
11 tic corporation organized and existing under the laws of the State of
12 New York, easements in and across two parcels of land of the State
13 University Agricultural and Technical Institute at Farmingdale, herein-
14 after described in section two of this act,] an easement of state lands
15 more accurately described in section two of this act, consisting of a
16 portion of the Stony Kill Farm Environmental Education Center under the
17 jurisdiction of the Department of Environmental Conservation for the
18 purpose of constructing and maintaining electric transmission lines,
19 upon such terms and conditions [including consideration as the board of

1 commissioners of the land office may fix and determine] deemed necessary
2 and appropriate.
3 § 2. [The lands in which the easements are authorized to be granted
4 and conveyed may be surveyed by the New York State Department of Public
5 Works for a more accurate description and may be granted and conveyed
6 according to such survey, but are generally described as follows: All
7 those two parcels of land situate in the Towns of Fishkill and Wapping-
8 er, County of Dutchess and State of New York, bounded and described as
9 follows: Parcel 1. Beginning at a point in the property line and center-
10 line of the Baxtertown Road between he lands of the State of New York
11 and Julius Moeller and at the southwesterly corner of lands of Ham, said
12 point being distant seventy-five feet easterly (measured at right
13 angles) from the survey centerline of the proposed central Hudson Gas
14 and Electric Corporation electric transmission line, thence south eight-
15 y-four degrees zero minutes west one hundred fifty-six and four tenths
16 feet along the aforesaid property line and centerline of the said road,
17 thence north ten degrees twenty-four minutes east three hundred sixty-
18 three and eight tenths feet, more or less, parallel to and distant
19 seventy-five feet westerly (measured at right angles) from the aforesaid
20 survey centerline to a point opposite an angle point in the aforemen-
21 tioned transmission line, thence north eleven degrees fifty-two minutes
22 west nine hundred sixty-two and three tenths feet, more or less, paral-
23 lel and distant seventy-five feet westerly (measured at right angles)
24 from the aforesaid survey centerline to a point opposite an angle point
25 in he aforementioned transmission line, thence north fifty-three degrees
26 fifty-seven minutes east eight hundred nineteen and seven tenths feet,
27 more or less, parallel and distant seventy-five feet northwesterly
28 (measured at right angles) from the aforesaid survey centerline to a
29 point opposite an angle in the aforementioned transmission line, thence
30 north eleven degrees eight minutes west thirteen hundred fifteen and
31 four tenths feet, more or less, parallel and distant seventy-five feet
32 westerly (measured at right angles) from the aforesaid survey centerline
33 to a point in the property line stonewall between the lands of the State
34 of New York and Edward M. Husted, thence north sixty-nine degrees four-
35 teen minutes east one hundred fifty-two and fourteen hundredths feet
36 along the said property line stonewall and across the aforesaid survey
37 centerline, thence south eleven degrees eight minutes east fourteen
38 hundred thirty-six and six tenths feet, more or less, parallel and
39 distant seventy-five feet easterly (measured at right angles) from the
40 aforesaid survey centerline to a point opposite an angle point in the
41 aforementioned transmission line, thence south fifty-three degrees
42 fifty-seven minutes west eight hundred eighteen and three tenths feet,
43 more or less, parallel and distant seventy-five feet southeasterly
44 (measured at right angles) from the aforesaid survey centerline to a
45 point in a dirt road in range with the sourtherly property line stone-
46 wall of lands of the State of New York, said point also being opposite
47 an angle point in the aforementioned transmission line, thence south
48 eleven degrees fifty-two minutes east eight hundred ninety-for and eight
49 tenths feet, more or less, parallel and distant seventy-five feet east-
50 erly (measured at right angles) from the aforesaid survey centerline to
51 a point opposite an angle point in the aforementioned transmission line,
52 thence south ten degrees twenty-four minutes west three hundred forty-
53 nine and one tenth feet, more or less, parallel and distant seventy-five
54 feet easterly (measured at right angles) from the aforesaid survey
55 centerline to the place of beginning, containing eleven and ninety-eight
56 hundredths acres, more or less. Parcel 2. Beginning at a southeasterly

1 corner of the lands of the State of New York approximately three hundred
2 twenty feet south of the Baxtertown Road at the line of lands of Julius
3 Moeller, said point being forty-seven and six tenths feet westerly
4 (measured at right angles) from the survey centerline of the proposed
5 Central Hudson Gas and Electric Corporation electric transmission line,
6 thence south eighty-one degrees fifty-five minutes west along lands of
7 Moeller twenty-eight and eight tenths feet, more or less, thence north
8 ten degrees twenty-eight minutes east fifty-one feet, more or less,
9 parallel to and distant seventy-five feet westerly (measured at right
10 angles) from the aforementioned survey centerline, thence south twenty-
11 two degrees forty-two minutes east forty-nine and six tenths feet, more
12 or less, along lands of Moeller to the place of beginning, containing
13 sixteen thousandths acres, more or less.]
14 The lands for which the Commissioner of General Services is authorized
15 by section one of this act to grant an easement to the Central Hudson
16 Gas and Electric Corporation are described as follows:
17 All that certain tract, piece or parcel of land situate in the Town of
18 Fishkill and Town of Wappinger, County of Dutchess, State of New York
19 and being more particularly bounded and described as follows:
20 BEGINNING at a point in the centerline of Baxtertown Road; thence
21 along the centerline of Baxtertown Road South 66°50'38" West 158.26 feet
22 to a point; thence through the lands of The People of the State of New
23 York (Liber 602, page 292) the following four courses and distance:
24 1. North 04°33'48" West, passing a capped rod set at 17.41 feet, a
25 total distance of 385.93 feet to a capped rod set;
26 2. North 26°59'24" West 960.41 feet to a capped rod set;
27 3. North 39°32'02" East 819.95 feet to a capped rod set;
28 4. North 26°07'06" West, passing a capped rod set at 1301.59 feet, a
29 total distance of 1309.70 feet to a point in the division line with of
30 Laura D. Ligotino, Margo S. Husted and Timothy J. Husted (Book 22011,
31 page 5219);
32 Thence along said division line North 50°18'46" East 154.31 feet to a
33 point; thence through the lands of The People of the State of New York
34 (Liber 602, page 292) the following two courses and distances:
35 1. South 26°07'06" East, passing a capped rod set at 22.69 feet, a
36 total distance of 1454.95 feet to a capped rod set;
37 2. South 39°17'11" West 123.02 feet to an iron pipe found;
38 Thence along the division line with lands of Paul Alfred and Pearl
39 Alfred (Book 974, page 113) and continuing along the division line with
40 lands of Executive Properties Services LLC (Book 22012, page 5488) South
41 39°17'11" West 663.49 feet to a point;
42 Thence through the lands of The People of the State of New York (Liber
43 602, page 292) the following three courses and distance:
44 1. South 39°17'11" West 33.16 feet to a capped rod set;
45 2. South 26°59'24" East 875.70 feet to a capped rod set;
46 3. South 04°33'48" East, passing a capped rod set at 347.80 feet, a
47 total distance of 365.21 feet to the point of beginning.
48 Containing 12.29 acres, being the same more or less.
49 Bearings refer to Grid North, New York State Plane Coordinate System,
50 Eastern Zone, based on the HARN System.
51 § 2. This act shall take effect immediately.
