AN ACT to amend the public authorities law, in relation to requiring
that any rules or regulations promulgated by the department of envi-
ronmental conservation pursuant to the climate action fund are subject
to a vote of the legislature for approval
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 1854 of the public authorities law is amended by
2 adding two new subdivisions 27 and 28 to read as follows:
3 27. All rules or regulations promulgated pursuant to subdivision twen-
4 ty-four, twenty-five or twenty-six of this section shall be subject to
5 approval by a majority vote of the legislature prior to implementation.
6 28. Pursuant to the climate affordability study described in subdivi-
7 sion twenty-six of this section, no recommendation generated by such
8 study shall take effect, and no monies shall be deposited into any of
9 the accounts described in subdivisions twenty-four and twenty-five of
10 this section, prior to approval by a majority vote of the legislature.
11 § 2. This act shall take effect immediately.
