        AN ACT to amend the social services law, in relation to certain data  to
          be  reported regarding child welfare preventive services; and to amend
          a chapter of the laws of 2020 amending the social services law  relat-
          ing  to  reporting  data  on  child  welfare  preventive  services, as
          proposed in legislative bills numbers  S.  8421-A  and  A.  10513,  in
          relation to the effectiveness thereof
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subdivision 11 of section 409-a of the social services law,
     2  as added by a chapter of the laws of 2020 amending the  social  services
     3  law  relating to reporting data on child welfare preventive services, as
     4  proposed in legislative bills numbers S. 8421-A and A. 10513, is amended
     5  to read as follows:
     6    11. (a) The office of children and family services shall  collect  the
     7  following data regarding preventive services, as defined in section four
     8  hundred nine of this title, and compile an annual report on such data by
     9  local social services district:
    10    (i) the total number of children and families admitted to or receiving
    11  a  new service authorization for preventive services [at the end of each
    12  month] during the preceding calendar year;
    13    (ii) the total annual number of  unduplicated  children  and  families
    14  receiving one or more days of preventive services including how many new
    15  preventive  cases  were opened during the preceding calendar year and to
    16  the extent [practicable] such information is known and  available  after
    17  making all diligent efforts, the referral source for each new case;
    18    (iii)  the  [average  length of time preventive services were provided
    19  for each child or family] total number of children  and  families  whose
    20  preventive services authorization was closed during the preceding calen-

     1  dar year[, as well as an indication of whether such case had been closed
     2  during such year];
     3    (iv) a descriptive list of the services and their utilization rate, if
     4  practicable,  in  each  local  social  services  district  which utilize
     5  preventive service  funding  as  allowable  under  section  one  hundred
     6  fifty-three-k of this chapter;
     7    (v)  a descriptive list[,] and their utilization rate, if practicable,
     8  of other  preventive  services  provided  by  a  local  social  services
     9  district  that  does  not utilize preventive service funding pursuant to
    10  section one hundred fifty-three-k of this chapter. For purposes of  this
    11  paragraph, other preventive services shall include but not be limited to
    12  primary  preventive  services  which  may  be  funded  through community
    13  optional preventive services funding[,] or home visiting funds [or other
    14  federal, state or local funds];
    15    (vi) the total number of children who entered foster care  during  the
    16  preceding  calendar  year  who  had  received preventive services at any
    17  point during the twelve-months prior to their entry  into  foster  care;
    18  and
    19    (vii)  any  other  information  the commissioner may deem necessary to
    20  include in said report.
    21    (b) The office of children  and  family  services  shall  submit  such
    22  report to the governor, the speaker of the assembly, the temporary pres-
    23  ident  of  the senate, the chairpersons of the assembly and senate chil-
    24  dren and families committees, the chairperson of the assembly  ways  and
    25  means  committee  and  the  chairperson  of the senate finance committee
    26  starting no later than September first, two  thousand  twenty-one.  Such
    27  report  shall  include data and information required by paragraph (a) of
    28  this subdivision for the preceding calendar year,  to  the  extent  such
    29  information  is  available.  When practicable, such information shall be
    30  disaggregated by age, sex, race and ethnicity.
    31    (c) The initial report shall include the aforementioned data from  the
    32  preceding two calendar years.
    33    §  2.  Section  2 of a chapter of the laws of 2020 amending the social
    34  services law relating to reporting  data  on  child  welfare  preventive
    35  services,  as  proposed  in  legislative  bills numbers S. 8421-A and A.
    36  10513, is amended to read as follows:
    37    § 2. This act shall take effect immediately and shall  expire  and  be
    38  deemed repealed September 1, 2024.
    39    §  3.  This  act  shall take effect immediately; provided however that
    40  section one of this act shall take effect on the same date  and  in  the
    41  same  manner  as  a  chapter  of  the  laws  of 2020 amending the social
    42  services law relating to reporting  data  on  child  welfare  preventive
    43  services,  as  proposed  in  legislative  bills numbers S. 8421-A and A.
    44  10513, takes effect.
