Bill Allowing Outdoor Dining With Dogs Moves through State Legislature

The state Assembly recently approved a bill sponsored by Assemblyman Angelo Santabarbara allowing restaurants to permit dining with companion dogs in outdoor seating (A. 5956-C).

The bill, which passed the state Senate earlier this year, gives restaurateurs the option of permitting diners to bring their pet dogs with them to outdoor eating areas. Dogs would only be allowed in the outdoor areas if the establishment meets certain sanitary requirements, such as ensuring there is no contamination of food and utensils.

“This legislation gives restaurants the flexibility to attract new customers and provide an enjoyable pet friendly dining experience. For most dog owners, like myself, their pets are part of the family and now restaurants will be able to take advantage of this new opportunity to have the entire family over for dinner,” said Assemblyman Angelo Santabarbara, D-Rotterdam.

“As a dog lover and restaurant owner, I think this legislation is going to make a lot of people happy and create some fun dining experiences,” said Matt Baumgartner, owner of Wolff’s Biergarten in Schenectady.

Current state law prohibits restaurants from allowing pet dogs into outdoor dining areas, despite a 2013 study from the Journal of Environmental Health that found there was minimal risk to public health. Additionally, similar legislation was overwhelming adopted by California and has broad support in New York.

If signed into law, the legislation would take effect immediately.
