AN ACT to amend the public health law, in relation to directing the
commissioner of health to collect data on the early intervention
program for infants and toddlers with disabilities
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 2557 of the public health law is amended by adding
2 a new subdivision 4 to read as follows:
3 4. The commissioner shall collect data, by municipality, on the early
4 intervention program authorized under this title for purposes of improv-
5 ing the efficiency, cost, effectiveness and quality of such program.
6 Such municipality data collection shall include but not be limited to:
7 (a) the total number of children, within a municipality, receiving
8 services by service type per week and the total number of services by
9 service type per week authorized by early intervention providers by
10 provider type including approved agencies, institutions, organizations
11 and independent providers;
12 (b) the number of services, by service type and provider type, that
13 were identified on the IFSP that were not delivered to a child;
14 (c) the number of medical assistance claims submitted, the percentage
15 of medical assistance claims denied and the percentage of medical
16 assistance claims paid, and the reasons for the denials;
17 (d) the number of claims submitted for other than medical assistance,
18 the percentage of claims denied for other than medical assistance and
19 the percentage of claims paid for other than medical assistance, and the
20 reasons for the denials;
21 (e) by municipality, the lapse in time between the completion of a
22 final IFSP and the initiation of services for all children; and
23 (f) the number and dollar amounts of claims submitted, by payor, that
24 not were paid within ninety days and the reasons for non-payment.

1 The commissioner shall report the information and analysis required by
2 this subdivision to the temporary president of the senate, the speaker
3 of the assembly, the minority leader of the senate, and the minority
4 leader of the assembly for the period May first, two thousand fifteen to
5 December thirty-first, two thousand fifteen on or before January first,
6 two thousand sixteen and for each calendar year thereafter on or before
7 January first for the preceding calendar year.
8 § 2. This act shall take effect immediately.
